Welcome to Bookkashmirhotels.com (the “Site” or “Platform”). This Site is fully owned and operated by Ambraoleia Hospitality Private Limited, under the leadership of Director Mr. Arvind Kumar Mishra (hereinafter referred to as the “Company”, “we”, “us”, or “our”).

Please read these Terms of Use carefully before accessing, using, or obtaining any materials, information, products, or services through our Platform. By accessing or using our website, you agree to be bound by these terms. If you do not agree to all of these terms, please do not use this Site.

1. SCOPE OF SERVICES

1.1. Bookkashmirhotels.com operates as an online marketplace and Online Travel Agency (OTA) facilitating hotel, houseboat, villa, resort, guest house, lodge, and homestay bookings across Srinagar, Gulmarg, Pahalgam, Sonamarg, and other regions.

1.2. The Platform acts strictly as an intermediary under Section 79 of the Information Technology Act, 2000. We aggregate hotel inventories, rates, and descriptions provided directly by independent accommodation owners or operators (“Property Partners”).

2. ELIGIBILITY & USER ACCOUNT

2.1. By using this Site, you warrant that you are at least 18 years of age and possess the legal authority to enter into a binding legal agreement under the Indian Contract Act, 1872.

2.2. If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and password. You accept full responsibility for all activities that occur under your account.

3. BOOKING & PAYMENT POLICY

3.1. Pricing Transparency: All rates displayed on the Platform are dynamic and set directly by the Property Partners. In compliance with Google Ads Policy and Consumer Protection Rules, the price confirmed at checkout represents the explicit dynamic listing price (inclusive or exclusive of explicitly stated statutory taxes like GST).

3.2. Payment Processing: Payments made on the platform are handled securely through authorized third-party payment gateways. The Company processes these funds in a fiduciary capacity for onward remittance to the Property Partner.

4. CANCELLATION, REFUNDS, & NO-SHOWS

4.1. Each Property Partner maintains its own independent reservation, cancellation, and refund policy, which is clearly displayed on the property details page before booking confirmation. By placing an order, you agree to that specific property’s terms.

4.2. In extreme events where a Property Partner fails to honor a confirmed booking (e.g., due to sudden local overbooking or operational failure), the Platform will make reasonable commercial efforts to assist in coordinating alternative accommodation of a similar tier. If no alternative is feasible or accepted, the platform is authorized to process a 100% refund of the transaction value back to the user’s original payment source. The Company holds zero secondary liability for supplementary consequential damages.

5. INTELLECTUAL PROPERTY & CONTENT USE

5.1. All content, trademarks, logos, brand markers, software code, design configurations, layout styles, and promotional text displayed on Bookkashmirhotels.com are the exclusive property of Ambraoleia Hospitality Private Limited and its directors.

5.2. Property photos, videos, and specific text listings provided by our Property Partners are explicitly licensed to Bookkashmirhotels.com and its corporate sister concerns for dynamic display, distribution, and marketing. You may not copy, scrape, republish, or distribute any media assets from this Site without explicit written authorization from us.

6. PROHIBITED ACTIVITIES

Users are strictly prohibited from:

  • Using automated tools, bots, scrapers, or spiders to scrape inventory data, pricing schemas, or property descriptions.
  • Making fraudulent, speculative, or false bookings in anticipation of demand.
  • Uploading or transmitting any viruses, malicious code, or deceptive content that disrupts the platform’s standard performance.
  • Deep-linking or framing any portion of this website for commercial purposes without prior permission.

7. LIMITATION OF LIABILITY & DISCLAIMERS

7.1. As-Is Basis: All hotel data, room amenities, proximity indicators, and media listed on the site are hosted on an “as-is” and “as-available” basis provided by the properties. While we enforce strict anti-misleading guidelines with our property operators, the Company does not guarantee absolute accuracy.

7.2. Disclaimer: Ambraoleia Hospitality Private Limited, its platform Bookkashmirhotels.com, and its Director Mr. Arvind Kumar Mishra shall not be liable for any direct, indirect, punitive, or consequential damages, accidents, loss of baggage, or service deficiencies arising directly from the localized operations of the selected hotel or houseboat partners.

8. GOVERNING LAW & JURISDICTION

8.1. These Terms of Use are governed by and construed in accordance with the laws of India.

8.2. Any legal disputes, consumer actions, or legal proceedings arising directly or indirectly from your usage of this Platform shall be subject to the exclusive jurisdiction of the competent courts of New Delhi, India.

9. AMENDMENTS TO TERMS

The Company reserves the right to revise, update, or alter these Terms of Use at any time without prior specific notification. Continued usage of the platform following any modifications implies your baseline acceptance of the updated terms.
